CHEEKY MONKEY BREWING CO “GIVE & WIN” PROMOTION TERMS AND CONDITIONS

1. Promoter

This Promotion is conducted by Cheeky Monkey Brewing Co Pty Ltd (ABN 76 138 444 998) of 44 Commerce Road, Vasse WA 6280 (“Promoter”).

2. Eligibility

a) Entry is open to residents of Western Australia aged 18 years or over.

b) Employees of the Promoter and participant stores, and their immediate family members are ineligible to enter.

c) By participating, entrants agree to be bound by these Terms and Conditions.

3. Promotional Period The Promotion commences at 12:01am AWST on 28/09/2026 and closes at 11:59pm AWST on 01/10/2026 or while stock lasts (“Promotional Period”). The Promoter reserves the right to extend, cancel, suspend, or amend the Promotion or these Terms and Conditions at any time, subject to regulatory approval where required.

4. Participating Stores

The Promotion is available at participating liquor retailers in Western Australia during the Promotion Period. The participating stores are The Liquor Shed Jandakot, Liquor Barons Wembley Downs, Liquor Barons Marmion and Liquor Barons Duncraig. The Promoter reserves the right to add or remove participating stores during the Promotion Period, subject to any applicable legal requirements.

5. How to Enter

a) To enter, an eligible entrant must purchase an eligible Cheeky Monkey Brewing Co 4-pack or cube from a participating store during the Promotion Period.

b) Following their purchase, the entrant must visit https://cheekymonkey.com.au/pages/give-win-terms-conditions and:

i. complete the online entry form;

ii. select the nominated community cause they wish to direct their donation to; and

iii. upload a clear and legible copy or photograph of their purchase receipt.

c) The purchase receipt must clearly show the date of purchase, participating store and eligible Cheeky Monkey Brewing Co product(s) purchased.

d) Entries will be subject to validation by the third-party promotion administrator appointed by the Promoter (“Promotion Administrator”).

e) An entry will not be valid if the receipt is illegible, altered, duplicated, fraudulent or otherwise unable to be verified.

f) Each purchase receipt may only be used once for the purposes of the Promotion.

6. Odds of Winning and Prize Limits

a) The odds of winning a prize in the instant-win game are determined by the specific eligible product(s) shown on the entrant’s validated purchase receipt.

b) Single 4-Pack Purchases: For each eligible 4-pack purchased, the odds of winning are 1 in 5. This consists of a 10% chance to win a single can prize, a 10% chance to win a 4-pack prize, and an 80% chance of winning no prize.

c) Cube Purchases: A cube is equivalent to four (4) 4-packs. For each eligible cube purchased, the odds of winning accumulate to 4 in 5. This consists of a 40% chance to win a single can prize, a 40% chance to win a 4-pack prize, and a 20% chance of winning no prize.

d) Cumulative Odds and 100% Cap: Where a receipt contains multiple eligible products, the odds proportionately accumulate based on the total 4-pack equivalent purchased, up to a strict maximum cap of 100%. Purchasing five (5) or more 4-packs in any format combination (e.g., five individual 4-packs, or one cube plus one 4-pack) guarantees a prize, with the outcome locked at a 50% chance for a single can prize and a 50% chance for a 4-pack prize.

e) Strict Prize Pool Limits: All odds and guaranteed wins described in these terms are strictly subject to available prize stock. The total promotional prize pool is limited to forty (40) 4-pack prizes and forty (40) single can prizes. Once this total allocation has been exhausted, the instant-win game will immediately conclude and no further prizes will be awarded, regardless of purchase volume or receipt combinations.

7. Community Donations

a) As part of the entry process, each entrant may select one (1) of the nominated community causes participating in the Promotion to receive a donation based on their purchase.

b) The Promoter has committed a total capped community donation pool of $1,000. c) Each nominated community cause will receive a guaranteed minimum donation of $100 from the total pool.

d) In addition to the minimum donation, the Promoter will allocate $2.00 for each eligible 4-pack and $10.00 for each eligible cube purchased on a successfully validated receipt to the entrant's selected cause, up to the $1,000 total pool limit.

e) If the total accumulated donations (including the $100 minimums and purchase-based allocations) do not exhaust the $1,000 pool by the end of the Promotional Period, the remaining balance will be divided equally among all nominated community causes.

f) Donations will be made by the Promoter directly to the nominated community causes following the conclusion of the Promotion.

8. Instant-Win Game

a) After submitting an entry and having their purchase receipt successfully validated by the Promotion Administrator, the entrant will be provided with access to the Promotion's instant-win game.

b) The instant-win game operates on variable odds based on the volume of eligible products purchased, as detailed in Clause 6.

9. Instant Prizes

a) The instant prizes available to be won are: 40 x Cheeky Monkey Brewing Co single cans, valued at $6 each; and/or 40 x Cheeky Monkey Brewing Co 4-packs, valued at $20 each.

b) The total instant prize pool is valued at $1,040. c) Prizes are not transferable or exchangeable for cash.

d) Instant prize winners will receive instructions for redeeming their prize at a participating store.

e) Prizes must be claimed within 24 hours and in accordance with the instructions provided to the winner.

f) Prizes are subject to availability at the participating store.

g) Prizes containing alcohol may only be supplied to persons aged 18 years or over and in accordance with applicable liquor laws.

h) The Promoter and/or participating retailer reserves the right to refuse the supply of an alcohol prize where required by applicable liquor laws or responsible service requirements.

10. Prize Redemption

a) The Promotion Administrator will provide successful instant prize winners with the information required to redeem their prize.

b) Prizes must be claimed in accordance with the instructions provided by the Promotion Administrator.

c) Prizes will be supplied by the participating retailer at which the prize is redeemed, subject to availability and applicable liquor laws.

d) The Promoter is not responsible for a prize being unavailable at a particular participating retailer.

e) Any prize not claimed by the expiry date will be forfeited and no replacement prize or compensation will be provided.

11. Promotion Administration

a) The Promotion is conducted by the Promoter and administered with the assistance of a third-party Promotion Administrator.

b) The Promotion Administrator will be responsible for operating the Promotion mechanics, collecting and validating entries, administering the instant-win game, notifying entrants of instant prizes and providing prize redemption instructions on behalf of the Promoter.

d) The Promoter remains responsible for the Promotion and the application of these Terms and Conditions.

e) The Promoter accepts no responsibility for entries that are lost, delayed, incomplete, incorrectly submitted or unable to be processed due to technical or other issues outside its reasonable control.

f) The Promoter reserves the right to amend, suspend or withdraw the Promotion where reasonably necessary due to circumstances beyond its reasonable control, subject to applicable law.

12. Responsible Service of Alcohol

Cheeky Monkey Brewing Co supports the responsible service and consumption of alcohol.

13. Privacy & Marketing

By entering the Promotion, entrants consent to their personal information being collected and used by the Promoter and its Promotion Administrator for the purposes of administering the Promotion, validating entries, managing community donations, administering the instant-win game, contacting entrants and facilitating prize redemption. By submitting an entry, entrants consent to receiving marketing communications from the Promoter, as disclosed in the entry form. Entrants may opt out of marketing communications at any time. 14. Liability

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights under the Australian Consumer Law or other applicable legislation that cannot be excluded. To the extent permitted by law, the Promoter is not responsible for any loss, damage, or injury suffered as a result of participating in the Promotion or accepting a prize.

15. General

a) The Promoter’s decision is final and no correspondence will be entered into.

b) The Promoter reserves the right to cancel, suspend, or modify the Promotion if necessary due to circumstances beyond its reasonable control.

c) This Promotion is governed by the laws of Western Australia. No permit is required for this Promotion in Western Australia.
